Property Tax Sale Information

Tax Levy sales are conducted by Ware County Tax Commissioner for unpaid State, County and School ad valorem taxes under the provisions of Title 48, Revenue and Taxation, Official Code of Georgia Annotated (O.C.G.A.), Governing Tax Executions and Sales; and Title 9, O.C.G.A, governing Judicial Sales. Properties scheduled for sale are advertised in the Saturday edition of the Waycross Journal Herald in the legal section under Sheriff Sales for four consecutive weeks prior to the sale. The sales are conducted on the first Tuesday of the month immediately following the final week of advertising. All tax sales will be held in the Ware County Administration Building, Board of Commissioners Room, located at 305 Oak Street, Waycross, GA 31501.

Sales are open to the public and a list of properties is available to the public in Room 115A of the Administration Building for at least one week prior to the sale, giving ample time to research properties and records. As tax liens are satisfied, the properties will be removed from the list.

The county does not guarantee title, and the purchaser has no use of the property, nor is entitled to any rent payments for at least one year under Georgia law.

The doctrine of Caveat Emptor shall apply to all sales (meaning this is a "Buyer Beware" sale).

Successful Bidders The successful bidder must be ready to pay the bid amount in CASH OR CERTIFIED FUNDS to the Tax commissioner immediately upon conclusion of the tax levy sale. Tax Sales are binding IAW O.C.G.A. 9-13-170.

All successful bidders will be required to present valid state issued identification.

Effective March 31, 2013: NEW Law Replaces "Birthday Tax" with Title Ad Valorem Tax (TAVT)
A new law that changes the way motor vehicles are taxed in Georgia went into effect on March 1, 2013. Motor vehicles purchased on or after March 1, 2013 and titled in this state will be exempt from sales and use tax and the annual ad valorem tax, also known as the “birthday tax”. These taxes will be replaced by a one-time tax that is imposed at the time the vehicle is titled on the fair market value of the vehicle called the title ad valorem tax (“TAVT”).

Timber Harvest Notification Ordinance
On September 8, 2008, the Ware County Board of Commissioners adopted a Timber Harvest Notification Ordinance which allows for the monitoring of Timber Harvesting, ensures the collection of the Timber Tax and provides notification to the Ware County Road Department about possible damages to County roads and rights-of ways while timber is being harvested. The ordinance requires that any timber harvesting contractor give notification to the Ware County Tax Commissioner prior to the harvesting.
